End User License Agreement

HESTER — STARFYRE SOFTWARE — EFFECTIVE AUGUST 2026

By downloading, installing, purchasing, or using Hester (the "Software"), you agree to be bound by the terms of this End User License Agreement (the "Agreement").

1. Purpose of the Software

Hester is designed as a privacy-first, offline analytical tool to protect authentic authors, neurodivergent writers, and marginalized voices from being flagged by AI detection systems. It empowers authors to maintain their authentic voice — whether purely organic or collaboratively drafted and heavily edited — without fear of discriminatory or unjust flagging.

2. Responsible Use Declaration

By using this Software, you declare and legally bind yourself to the following terms of responsible use:

Age of Majority: You warrant that you are at least 18 years of age, or the age of legal majority in your jurisdiction, or that a parent/guardian has agreed to this Agreement on your behalf.
No Academic Dishonesty: You shall not use Hester to launder, disguise, or submit AI-generated or AI-assisted content for academic credit, grading, or institutional evaluation.
No Plagiarism: You shall not use Hester to facilitate, disguise, or launder plagiarized works belonging to another author, entity, or generative model where such use violates the original author's copyright or licensing terms.
No Disinformation: You shall not use Hester in the mass production of automated disinformation, spam, or malicious bot networks.

3. Safe Harbor & Non-Infringement

Hester operates solely as a local linguistic analytical text processor. It does not bypass Digital Rights Management (DRM), nor is it designed, marketed, or intended to facilitate copyright infringement under the Digital Millennium Copyright Act (DMCA) or equivalent international statutes.

4. Disclaimer of Warranty

At StarFyre Software, we are relentlessly committed to providing state-of-the-art writing analysis tools. Hester is rigorously tested and continuously updated with the latest generative signatures to offer you the strongest possible analytical capability.

However, because third-party AI detectors are inherently opaque, rapidly changing, and frequently erratic, no software can guarantee any specific outcome on any third-party platform. Therefore:

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL STARFYRE SOFTWARE, ITS SOFTWARE DESIGNER/DEVELOPER, COMPANY PARTNERS, SOFTWARE TESTERS, OR ANY AFFILIATED PERSONNEL BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE. YOU, THE END-USER, ASSUME 100% OF ALL LIABILITY AND RISK ASSOCIATED WITH YOUR USE OF THIS SOFTWARE.

5. Indemnification (Hold Harmless)

You agree to indemnify, defend, and hold harmless StarFyre Software, its affiliates, officers, and employees from any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with your violation of this Agreement, including but not limited to the misuse of the Software for academic cheating, plagiarism, or copyright infringement.

6. No Guarantees Regarding Third-Party Evaluation

Hester provides statistical analysis of textual patterns to identify phrases commonly associated with AI-generated content. StarFyre Software makes no warranties or guarantees regarding the outcome of evaluations by third-party algorithmic detectors, academic institutions, publishing platforms, or employers.

7. Governing Law

This Agreement is governed by the laws of the jurisdiction in which StarFyre Software operates.

8. Limitation of Liability

To the maximum extent permitted by applicable law, StarFyre Software's total cumulative liability to you or any third party arising out of or in connection with this Agreement or the use of the Software shall not exceed the actual amount you paid to StarFyre Software for the purchase of the Software.

9. Mandatory Binding Arbitration & Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to this Agreement or the breach thereof shall be settled exclusively by binding, individual arbitration, and you waive your right to a trial by jury. YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST STARFYRE SOFTWARE ONLY IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

10. Intellectual Property

All code, signatures, and proprietary logic within Hester and the ATI Signature Compiler remain the exclusive intellectual property of StarFyre Software. Reverse engineering, decompiling, or redistributing the Software without explicit permission is strictly prohibited.

By purchasing or continuing to use Hester, you acknowledge that you have read, understood, and agree to be bound by this EULA.
