Terms of Service

1. The StarFyre Account

• Eligibility: You must provide accurate and complete information when creating an account.
• Age: You must be at least 13 years old, or the minimum age in your country if it is higher.
• Security: You are responsible for maintaining the confidentiality of your login credentials and any third-party API keys (BYOK) you store within our system. StarFyre Software is not liable for unauthorized access resulting from your failure to secure your credentials or external provider accounts.
• One Identity: Your StarFyre Account acts as the central identity across all products currently available or made available in future. A ban or restriction placed on your account applies globally to the ecosystem.

2. Intellectual Property (IP) Rights

StarFyre Software exists to empower creators.

• Your IP: You retain full, unencumbered ownership of all original content, manuscripts, worldbuilding data, and assets you create and/or generate, store, or export using our tools.
• Our IP: StarFyre Software retains all ownership rights to the software, interfaces, codebases, and underlying technologies provided to you, as well as any original IP provided with those products at time of shipping or made available as DLC or aftermarket patch content.

3. AI Services, StarFuel, and BYOK (Bring Your Own Key)

A. StarFuel (Internal Credits)

• Usage: "StarFuel" is our internal ledger system used to allocate AI generation limits. Subscriptions or one-time purchases grant you a specific amount of StarFuel.
• Non-Refundable: Once purchased or consumed, StarFuel is non-refundable, except where required by law.
• Service Availability: While we strive for 100% uptime, StarFuel usage relies on third-party LLM providers. We are not liable for generation delays caused by upstream provider outages.

B. Bring Your Own Key (BYOK)

• If you choose to use your own API keys (e.g., OpenAI, Anthropic, Google Gemini) via our routing system, you are entirely responsible for the costs incurred on those external accounts.
• You agree to abide by the Terms of Service of your chosen third-party AI provider. StarFyre Software reserves the right to suspend BYOK access if your key is used to consistently bypass safety filters in a manner that violates upstream provider terms, potentially risking StarFyre's organizational standing.

4. Third-Party Integrations (Google, GitHub, etc.)

• If you authorize StarFyre Software to export your creations to external services (e.g., a private GitHub repo or Google Drive), you grant us temporary, limited permission to push that data on your behalf.
• We are not responsible for the availability, data loss, or terms enforcement of those third-party platforms once your data has been exported to them.

5. Acceptable Use

You agree NOT to use the StarFyre Account or our applications to:

• Generate, distribute, or promote illegal content.
• Attempt to bypass, exploit, or reverse-engineer the StarFyre Platform's security, billing, or Admin authorization constraints.
• Overload our infrastructure via automated, malicious scraping or denial-of-service attacks.
• Engage in prompt injection or malicious manipulation of the underlying AI models.

6. Termination

We reserve the right to suspend or terminate your StarFyre Account if you breach these Terms. Upon suspension, your right to use the applications will immediately cease. You will have a period of 30 days to appeal a suspension or termination by contacting support@starfyresoftware.com. If an appeal is not submitted, or if the termination is upheld after review, your account will be finalized and your encrypted tokens and data will be permanently purged in accordance with our Privacy Policy.

7. Limitation of Liability

In no event shall StarFyre Software, its owners and personnel, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the service.

9. Genesis

These terms apply to Genesis in addition to everything above. They are written in plain words on purpose.

A. What Genesis is, and is not

• A creative tool: Genesis is an interactive tool that helps you develop an idea of your own (a story, a game or campaign, a non-fiction work, a business idea or a personal memoir) by asking questions. It uses generative artificial intelligence. AI can be wrong, so check what matters to you.
• Not professional help: Genesis does not give medical, psychological, therapeutic, legal, tax or financial advice, and it is not a crisis service. It is never a substitute for a private conversation with a trusted, trained mental health professional. If you or someone else is in danger, contact your local emergency number or a crisis line.
• Age: You must be at least 18 years old to use Genesis.

B. Your words, and your responsibility for them

• Ownership: What you write in Genesis is yours (see section 2). Genesis keeps track of which words you wrote and which were AI suggestions you chose to use.
• Real people: If you write about real people, especially living people, you are responsible for what you publish about them, including privacy and defamation. A pseudonym is always an option. Genesis does not write statements about real people for you.
• Other people's rights: Do not enter material you do not have the right to use, such as someone else's manuscript or confidential information.

C. What Genesis will not work with

• Never: Genesis will not write, ask for or build on graphic torture, rape, murder, body horror or gore, and will not work with sexual content involving a minor or child sexual abuse. Consensual activity between adults is not restricted by this rule.
• Backstory only: In narrative fiction, Genesis can ask about murder, sexual assault or non-consensual sex only as backstory (that it happened, who it touched, what it left behind), never as a scene. Outside narrative fiction it does not ask about them.
• Locked stars: If child sexual abuse or sexual content involving a minor appears in a story or personal narrative, the star is locked: it is removed from the nursery, kept away from the AI, and left out of your export. If three or more stars are locked, the build is paused: you can export what you have and delete the build, and nothing else until support has reviewed it. Email support@starfyresoftware.com to explain any context we should know; we will decide whether to unlock the build.
• The law: We follow the law, including any duty to report apparent child sexual abuse material. We may refuse, remove or lock content, and suspend accounts, as described in section 6.

D. Purchases and refunds

• Per build: Genesis is sold per build at $25.00 USD (introductory price). One purchase is one build. Reopening or expanding a finished build is $25.00 USD. The price is always confirmed before you pay.
• Refunds: Because generating AI suggestions costs real money as you use them, a build that has been worked on is not refundable. If a technical fault stops a paid build from starting or generating before you have made meaningful progress, email support@starfyresoftware.com within 14 days and we will replace it or refund it. Nothing here limits rights you have under the law where you live.
• Free access: Some people are given free access. Anyone who shares an opinion about Genesis in return for free access must say so clearly.

E. Availability

Genesis depends on outside AI providers and may be slower or unavailable when they are. Your work is saved on your device as you go, and you can export it at any time, as Markdown or JSON.
